The Tánaiste Frances Fitzgerald has ruled out asking the Garda Commissioner Nóirín O’Sullivan to reveal details of her dealings with her own legal team.

Fitzgerald has said it is not fair to ask the Commissioner to waive the privilege that anyone else would have with their lawyers.

Last night it emerged that lawyers for the Commissioner had withdrawn their questions about the integrity of whistleblower Maurice McCabe, but not about his motivation.

However speaking in the Dáil, Minister Fitzgerald ruled out asking the Commissioner herself to release more details.

“It seems to me that it would be a sufficient change to the generally accepted position that communications between a lawyer and a client should not have to be put in the public domain,” said Fitzgerald.

“To put it mildly it would be very unusual to ask any party to a legal proceeding to unilaterally disclose its dealings with its legal representatives.”
