Console’s legal action against the charity’s founder Paul Kelly, his wife Patricia and their son Tim is due back before the High Court this morning.

Last week, the court heard that Paul Kelly’s solicitor wasn’t in a position to take instructions from his client because he was in a psychiatric unit.

Today will be Tim Kelly’s first opportunity to reply to freezing orders placed on his assets in his absence last week.

His parents were also given until today to file replying affidavits, but it is not clear if Paul Kelly’s solicitor has been able to consult with him since the court heard he was admitted to a psychiatric unit.

The orders were granted After a HSE audit revealed the Kellys received almost half a million euro in salaries and cars between 2012 and 2014 and put a further €464k on credit cards linked to the suicide charity.

Various injunctions were also made against Paul Kelly’s sister Joan McKenna, but her case was adjourned until next week to allow her claim that she was never a director of the charity to be investigated.

The court heard her name appears on documents submitted to the Companies Registration Office, but she claims they were forged.
