The freezing order on the current account of former Console CEO Paul Kelly has been lifted, but the High Court denied Paul Kelly and his wife Patricia access to their savings account.

Mr Justice Paul Gilligan gave the Kellys access to an overdrawn current account to allow them to receive social welfare payments and pay for living expenses.

However, he refused them access to a savings account with €6,700 in it.

The Kellys wanted to use that money to pay mortgages and legal bills, saying they had no other cash assets or income.

Mr Kelly (pictured) is waiting for a P45 from Console for an application to the Department of Social Protection. However, the computer needed to process this was seized by the Director of Corporate Enforcement.

Representation for Console’s provisional liquidator said they believed the €6,700 in the savings account belonged to the charity.

The Kellys have been given nine days to prove it is in fact their money and does not belong to Console.

The case resumes next Thursday at the High Court.
