A man accused of raping his friend at an apartment in Dublin told Gardaí that she may have made a pass at him.
Following his arrest in 2009, he also said he did not believe her allegation of rape and that he may have been sleepwalking if he did have sex with her.
The man told Gardaí they travelled to Dublin on September 27th 2008. He was 21 at the time and she was a year older.
After a night out in Copper Face Jacks, he said they went back to another friend’s apartment to stay the night.
They got into a spare bed but he said he had nothing sexual in mind, even after all the drink. He said he would never have cheated on his girlfriend.
He said his next memory was a vague semi-awake one. He said he just remembered her asking if he was wearing a condom but no recollection of having sex.
He said he a history of sleepwalking and his girlfriend would often wake up to find him grinding up against her.
The court heard he sent her a number of texts that day. One of them said “devastated and incredibly sorry”.
He told Gardaí he initially believed her when she said he had raped her but had changed his mind and even thought she may have made a pass at him.
The trial will resume on Monday.
